1. Booking, payment, refunds and cancellations
1.1 Provisional bookings do not guarantee participation in Torque Motorsport events or use of Torque equipment until payment has been received in full.
1.2 The booking will be confirmed once payment has been made and funds have been received.
1.3 A VAT receipt will be sent once payment has cleared. An invoice can be requested beforehand but will not otherwise be sent.
1.4 Torque events and equipment are booked on a ‘first-come-first-served’ basis and bookings are not guaranteed until full payment has cleared.
1.5 It is possible that events for which Torque equipment has been hired will be cancelled prior to the event date. If that occurs then Torque cannot be held liable or responsible for any loss or expense incurred by You. Examples may include a circuit withdrawing a track day that you have booked. In such instances Torque will attempt to compensate you in the form of equipment hire on an alternative day or a credit note valid for 12 months from the date of issue. Refunds will not be issued.
1.6 It is possible that events for which Torque equipment has been hired will be cancelled on the event date. If that occurs then Torque cannot be held liable or responsible for any loss or expense incurred by You. Examples may include a circuit not being able to operate due to extreme weather conditions. In such instances compensation or arrangement of hire on an alternative day will be at the discretion of the Torque management team.
1.7 Cancellations of equipment hire by You more than 14 days prior to the event will receive a 50% refund, or 75% credit note.
1.8 Cancellations of equipment hire by You 7-14 days prior to the event will receive a 25% refund, or 50% credit note.
1.9 Cancellations of equipment hire by You less than 7 days prior to the event will not receive a refund unless the equipment can be hired to another customer.
2. Pricing
2.1 Pricing on the website and marketing literature are indicative prices only and are subject to change. Torque reserve the right to vary pricing for the same event or service dependent upon demand.
2.2 Once payment has cleared and the booking has been made, price fluctuations will not affect this booking.
3. Unsafe conditions
3.1 In the event of severe weather conditions, or other unsafe surroundings the decision on whether it is safe for cars to use the circuit will be made by the circuit organisers on events not run by Torque. Torque respects their decision and shall not question this decision. If that occurs then Torque cannot be held liable or responsible for any loss or expense incurred by You.
3.2 If conditions change during the day, driving standards will be reassessed in accordance with the driving standards in section 7.
4. Red flags / other circuit interruptions
4.1 It is possible that during your experience there will interruptions to the day. Whether this is a Torque run day or otherwise this is for the safety of all participants and staff, and priority will be given to their safety over and above track time to other participants. No refund or compensation will be given due to circuit interruptions.
4.2 If the red flag / interruption is as a result of your actions, Torque reserves the right to suspend Your use of equipment or the circuit until a medical check has been completed and Your driving standards have been assessed. You will not be asked to pay compensation to any other event participants.
5. Black flags / driving standards
5.1 Driving standards will be constantly assessed during your experience or event by a qualified ARDs instructor. If your driving is deemed to be dangerous or inappropriate, you may receive a warning or be asked to return to the pits. In such instanced Torque reserve the right to end the experience early in the event of driving standards that are deemed to be dangerous by an instructor. We will however try to avoid this by offering a series of instruction and warnings. No refund or compensation will be given due to event interruptions.
5.2 It is possible that You may take issue with another participants’ driving standards. In this instance you should not approach them directly, but should make a member of the Torque team aware of this. If You challenge the third part directly and subsequently have an accident with them, You will be liable for all costs.
5.3 You must observe all the rules imposed on the day’s event. This includes but is not limited to observing the flags and lights, overtaking procedures and pitlane etiquette. In the event that these are not followed, 5.1 applies.
6. Accident damage / wear and tear
6.1 Who is at fault for an accident will be determined by a qualified instructor, who will review the footage and speak with all witnesses. As a guideline, You are deemed to be at fault if:
6.1.1 You make contact with a vehicle in front of You
6.1.2 You ‘spin’, enter a gravel trap, or make contact with a barrier and no other party was involved, and this was not due to a mechanical failure
6.1.3 You make contact with a vehicle attempting to overtake due to not having seen it
6.1.4 You have an incident due to misuse of the equipment, such as hitting the wrong pedal
6.1.5 Damage is done to the car due to over revving it, such as selecting the wrong gear
6.1.6 You have not appropriately observed instruction or flag / light signals
6.2 In the event that You disagree with the outcome determining who is at fault, a second opinion will be gained from another instructor.
6.3 When hiring Torque equipment, wear and tear is included in the price, as is the use of all disposables. In this instance wear and tear includes but is not limited to, parts failing due to longevity, stone chips to the paint work, the equipment getting dirty. In this instance disposables include tyres, fuel, oil and coolant.
6.4 In the event of damage to hired equipment, You shall be liable to pay for the following:
6.4.1 If on the standard package, all damage regardless of who is at fault
6.4.2 If on the enhanced package, all damage if You are at fault, no damage if you are not deemed to be at fault
6.4.3 If on the elite package, you will not be liable for any damage
6.5 If you have an accident, you will be entitled to use a replacement car if you have opted for the elite package. This is regardless of who is at fault. A replacement car will be made available within one hour of the accident.
6.6 On the standard or enhanced package no replacement car will be made available, regardless of who is at fault.
6.7 This section is Torque’s policy and does not constitute and insurance policy.
7. Driving standards
7.1 All Drivers must produce evidence of holding a current EU driving licence and must sign the Torque Driver Indemnity Form and/or Track Day Declaration. No Driver can participate who does not conform to this Condition. The Torque Driver Indemnity document is a constituent material part of these General Terms and Conditions. You agree that and You understand that any participation in an event or driving on a race track constitutes a potentially hazardous activity and You have volunteered to take part in Torque Event or have hired Torque equipment at entirely Your own risk.
7.2 Torque reserves the right to terminate any Driver’s participation in an Event if in the opinion of Torque the Driver is unsuitable mentally or physically or by presenting in inappropriate dress to commence or continue participation in the Event or in the event of any damage to Torque property, or to any vehicle or component of any vehicle or to the property of any third party or of the venue. In such circumstances no refund will be made.
7.3 Hire of Torque equipment or participation in a Torque event assumes that safe driving standards will be achieved. If, in the opinion of Torque, safe standards are not being achieved, Torque reserves the right to interrupt the event or cease the activities. No refund or compensation will be given.
7.4 It is Torque’s policy to make the experience as enjoyable and safe as possible, and in the first instance if there are driving standards issues we will attempt to rectify this through the appropriate instruction.
7.5 Timing and competitive driving is forbidden, unless on a recognised ‘testing’ or race day.
7.6 When hiring Torque equipment your driving standards and safety will be constantly assessed. If, in the opinion of Torque, safe standards are not being achieved, Torque reserves the right to interrupt the event or cease the activities. No refund or compensation will be given.
7.7 Aggressive or threatening behaviour towards any Torque personnel or any other person at a Torque event will result in termination of the event for You. No refund will be given and the decision of BookaTrack.com is final.
8. Suitability to drive
8.1 Torque do not discriminate in any way when allowing participation in events or equipment hire, however a ‘common sense’ approach is used. If You are not physically or mentally able to use the equipment safely, You will not be allowed to do so. This is at the judgement of Torque.
8.2 Due to the nature of some equipment, size or weight restrictions may apply. Torque will endeavour to modify equipment where realistically possible, however if you do not declare your size when agreeing to participate and subsequently do not safely fit in the equipment, You will not be allowed to participate.
9. Instruction
9.1 As part of your experience with Torque you may receive some instruction. This will be from experienced and qualified race drivers / instructors. However Torque cannot accept any liability for driving as a result of instruction. You are solely responsible for Your actions.
